Agreement
These Terms of Service govern your use of Hydracept, including hydracept.com, the Hydracept API, documentation, and related services (the “Service”). The Service is provided by Zencode Consulting Inc. (“Zencode,” “we,” “us”). By using the Service, you agree to these terms. If you use the Service for an organization, you confirm that you have authority to bind that organization.
Your account and keys
You are responsible for activity under your account and for keeping your Hydracept API keys and provider credentials secure. Do not place those credentials in shipped clients or other public code. Notify us promptly if you believe your account or keys have been compromised.
Inputs and generated output
You retain your rights in prompts, files, reference assets, and other material you submit to the Service (“Inputs”). You represent that you have the rights and permissions needed to submit those Inputs and to instruct us and our providers to process them.
As between you and Zencode, and to the extent permitted by applicable law, Zencode assigns to you any right, title, and interest that Zencode may acquire in output generated specifically for you through the Service (“Output”). AI-generated material may not qualify for intellectual-property protection, may be similar or identical to material generated for others, and may be subject to third-party rights or provider terms. You are responsible for evaluating whether your intended use of Output is lawful and appropriate.
You grant Zencode a limited, non-exclusive license to process Inputs and Output only as reasonably necessary to provide, secure, support, and operate the Service, comply with law, and enforce these terms. Our handling of personal information is described in our Privacy Policy.
BYOK, managed inference, and third-party providers
Hydracept can run jobs using provider credentials you connect (“BYOK”) or, when offered, using managed inference funded through your Hydracept wallet. With BYOK, you are responsible for your agreements with those providers and their charges. For managed inference, Hydracept selects or uses the provider described by the accepted quote or job contract. Provider availability, models, output, and terms may change and are outside Zencode’s control.
The Service relies on third-party infrastructure and inference providers to perform requested work. Those providers may process Inputs and Output as subprocessors or independent service providers under their own applicable terms and privacy commitments. Do not submit material to a capability unless its provider and data-handling terms are acceptable for that material.
Acceptable use and minors
You may use the Service only in compliance with applicable law, these terms, and provider requirements. You must not use the Service to create, request, upload, facilitate, or distribute illegal content; child sexual abuse material or sexual content involving minors; content that exploits or endangers children; malware or credential theft; material that infringes another person’s rights; or activity intended to evade security, billing, usage, or safety controls. You must not interfere with the Service or use it to facilitate unlawful access to systems, accounts, domains, or other resources.
The Service is intended for adults and for organizations whose authorized users are adults. It is not directed to children under 13, and you must not knowingly provide us with personal information from a child under 13 through the Service.
Preview and evolving capabilities
Hydracept is an evolving service. Capabilities identified as beta, preview, experimental, or otherwise pre-release may change materially, produce unexpected results, or be withdrawn without notice. Do not rely on preview capabilities for safety-critical, life-critical, or other uses where failure could cause serious harm. You should review quotes, receipts, artifacts, and provider-specific constraints before relying on generated work.
Service changes and availability
We may update, add, suspend, or discontinue parts of the Service. Generation and execution jobs depend on third-party providers and infrastructure and may fail, be delayed, or become unavailable. You should retain your own copies of important assets and outputs.
Fees, plans, and wallet charges
Hydracept currently offers Free, Builder, and Team service tiers; current plan prices and limits are shown on the Service and may change prospectively. Paid subscriptions are billed through Stripe until canceled through the billing controls we provide.
BYOK inference carries no Hydracept inference fee; the connected provider bills you under your provider account. For managed inference, the quote presented before paid execution states the estimated customer charge. The managed price includes the underlying provider cost plus Hydracept’s managed-service fee, currently 6%. Your wallet is charged according to the accepted quote and final reconciliation for the job. If a capability-specific quote or checkout screen states a different price or fee before you accept it, that disclosed transaction price controls for that transaction. You are responsible for applicable taxes and all authorized charges associated with your account.
Disclaimers and liability
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind. Zencode does not warrant that the Service or Output will be uninterrupted, error-free, secure, suitable for a particular purpose, unique, eligible for intellectual-property protection, or free of third-party claims. To the maximum extent permitted by law, Zencode’s total liability arising from the Service will not exceed the amounts you paid to Zencode for the Service during the twelve months before the event giving rise to the claim.
Termination
You may stop using the Service at any time. We may suspend or terminate access when we reasonably believe these terms, the law, provider requirements, or Service security require it. Provisions that by their nature should survive termination will survive.
